Drone Services Agreement

Between Dostal Technology LLC d/b/a Dostal Aerial (“Provider”) and the client. Flat package fee, no hourly billing.

1. Services & Deliverables

The selected package/SOW — aerial photo/video, inspection imagery, property-intelligence analysis, and/or mapping. Delivered digitally within an agreed number of business days, weather/airspace permitting.

2. Fees

Flat fee per the Statement of Work. No hourly billing. Invoices due within 15 days; late amounts accrue 1.5%/month. Travel beyond 25 miles billed separately.

3. Regulatory compliance

Provider operates under 14 CFR Part 107 with a valid FAA Remote Pilot Certificate and handles LAANC/Remote ID/registration. Client is responsible for ensuring Provider has lawful access to the property.

4. License & usage

Client gets a non-exclusive, perpetual license to use delivered media for marketing the property. Provider retains raw footage, source data, and the underlying tooling — and the right to use media in Provider's own portfolio, unless the client opts out in writing (see the Release below).

5. Property-intelligence disclaimer

Any terrain/boundary/slope/drainage/acreage figure is derived from public GIS/LiDAR data and non-survey-grade capture (no RTK, ~1–3m accuracy). Not a legal survey or engineering document — consult a licensed surveyor/engineer for authoritative determinations.

6. Insurance & liability

Commercial drone liability insurance (COI on request). Liability limited to fees paid; not liable for indirect/incidental/consequential damages.

Property Access & Footage Release

Signed by the property owner or authorized agent before every shoot — this is what makes the flight legal and the footage usable.

1. Authority & access

Owner represents they own or are authorized to grant access, and permits Provider to fly over and around the property on the agreed date(s).

2. Grant of rights

Owner grants Provider a perpetual, royalty-free license to use captured media (including tours and intelligence views) in Provider's portfolio, website, and marketing — with an explicit opt-out checkbox if the owner would rather it stay private to their own deliverables.

3. No identifiable persons or neighbors

Provider makes reasonable efforts to avoid capturing identifiable individuals or neighboring private property, and excludes or blurs any that appear.

4. Privacy

The property's street address, owner name, or other personal information is never published without separate written consent.
